Michael not getting out of prison until Nov 2011
It is true, Michael is not getting out as we all hoped. This is not his fault at all! He did what they told him to do, as he completed the drug program and had no major write-ups. The CR Committee approved him leaving, but it had to be approved in Albany. For some reason they said no. The prison thinks that maybe it's because of the cases around the USA where someone is released early and re-offends, and then the media jumps on it wanting to know why he was let out!
The entire Coxsackie Prison staff are behind Michael, and they showed this by taking him aside with caring people for him to talk to when he opened his letter. They believed he was getting out, as 99.9% of approvals at Coxsackie are approved in Albany. They told him they have faith in him, are rooting for him, and will stay behind him. Michael will still need to stay drug and write-up free until the day he can be released or risk losing some Good Time and delaying his release.
As you can expect Michael is devastated! He was more accepting than usual of my encouraging words, but with time this may eat away at him. He needs friends now, especially those who can visit and give something as simple as a hug! Please email me at comments@michaelaligblog.com to schedule a visit.

I can even express my sadness for Michael. I will continue to be a loyal penpal and alway ALWAYS give him words of encouragement. Next year, I will visit him again.

Oh Damn! What for a shit! I'm so sad about all this! Poor Michael! I hope he will get over it till he's out. I think on him every day. Michael we all love you and will stand behind you! Albany sucks!

But he is FOR SURE getting out in 2011, right? As long as he doesn't get in trouble with drugs or anything? Because I remember hearing somewhere that in 2010 they had to tell him WHEN he was getting released.
Anyway, that sucks a lot.

No, it's not "for sure" that he'll get out in Nov 2011. He will have to go through what he just went through, he'll earn more Good Time just being there, but can also lose some. The CR Committee would probably say yes again, it would be Albany not signing off on it (like this time) that would be the problem. I doubt they would do that again though. With Michael being good for one more year, he will have shown that he is serious (well he IS now!) about flying right and leaving trouble behind.

I wanted to give a link that is current and accurate as to dates assigned to MA.
Here you can see, that it is still very possible to be released IF AND ONLY he stays clean and involved. His release will be decided by prison staff! Use your imagination Michael! Be creative with involvement and grin/bare the negative. Be strong buddy.

I don't think the DOC info is correct, as it was the same before he had the latest results. If Michael stays out of trouble, he won't lose anymore good time, plus he earns more the longer he's there. The issue for deciding is not directly the prison staff, as the CR committee at the prison said yes, it was people in Albany that rejected Michael and stopped him from leaving. If he doesn't get into trouble, and gets all his good time back, the prison will approve him. It will still go to Albany for approval, and that's what worries Michael, as he's worried the same thing will happen.

Love, you are absolutely right. It won't only be the decision of DOC. The committee can and will ask the DOC to bring them up to date on his progress at anytime and DOES NOT have to be on any said date. This could actually happen at ANY TIME. Especially when end of year reports come along and the state needs to trim dollars. SO.. he just needs to stay envolved with as many programs and remain a clear and obvious stand out and obscenely and overly cooperative. Even asking to be kept busy. Seeking the opportunities to show both the decision makers and Michael to be that determined and learn/grow/change. All of this is open to him, they want to see him want this. This is a very close scenerio that just played out with someone else close to me. Now out for 2 months and the above was what did it for him. So believe me, this step is the end. ONLY, if he applies himself and show it. Remember he will be reminded of his crime in mean, cruel, insensative, over whelming force from media and public on a constant for a very long time. This will be very draining and will take strength and support. Just one slip of his behaviour after release, he'll go back and go back hard! STAY IN THE PROGRAMS TILL THE END. This will only be a good thing both in and out.

From what Michael has told me, I really don't think the CR Committee "will be asking DOC for an update" as the Committee is at the prison so knows exactly what Michael has been up to. Michael only will see the Committee when it is scheduled, which means around the time he could get out. The first time was based on the fact that he served a certain % of his sentence. After that, it's when they tell him to come back when he's rejected. Cutting the budget will not get him out, as they just cram more inmates into a prison, or what they have been doing lately is close some prisons because there has been a decline in inmate population.
I agree that keeping busy and taking classes and everything he can could help, but if there's no classes or programs available what can he do? He might put in for a transfer to Medium Security because there are more programs there, plus he could get closer to NYC where his friends and support are.
I don't know if the media or public protest will help or hurt his chances, as the DOC can keep him for 20 years if they really want to. Michael has no legal rights like he did when he was on the outside, so no Lawyer, no appeals. It sounds crazy but it's true.

When I read "For some reason, they (Albany) said no," I realized it's come down to a matter of politics. The "people in Albany" is probably the state attorney general's office of Andrew Cuomo, currently the state attorney general AND running for governor of New York. (He's WAY ahead in the polls over "Wack-in-the-Box" Carl Paladino, so he'll probably win that election, but I'm sure Cuomo and his people are looking down the road on this one.)
When Huckabee was governor of Arkansas, he allowed for the release of a guy who eventually went out and killed 4 cops, so that bit him in the ass when he ran for president. So yeah, it's all about politics for Michael from this point on.
I would guess by announcing that his release date has been extended to November 2011, the governor's office (Cuomo?) is simply covering their bases until after the election. In a political sense, Michael's lucky that Cuomo's a Democrat. A hardcore Republican would never give him the time of day.
Perhaps Michael should wait till after the election and consider petitioning the newly-elected governor himself, or have others begin a petition campaign to have him released. Especially those who knew Michael back in the club kid days who have since "rehabilitated" themselves and have now become New York area professionals, business people, such as artists, writers, etc.
It's a ridiculous game he has to be played, but that's what it's come down to. But it will end for him!

With no legal rights or chance to go in front of the CR Committee until it is scheduled, I think that the best thing to do is give Michael support and encouragement. Write him letters, send him books...anything to keep his mind busy! He loves hearing from people who care about him and now is a time where he's going to need it the most. I've found that a lot people talk about writing or visiting him, but they never actually do it. Michael is a very dedicated person and he will respond to your letters and would absolutely love a visitor. I had a fabulous visit with him & I probably write him once a week. Always wishing him the best!

Most definitely! He does get a lot of letters, but he responds to everybody. He is so appreciative of his supporters.
