A lot of people email me, or leave comments, wanting to know what's going on with Michael. For a while we knew nothing, now we know some things, but it's not over.

Michael had a hearing, and was found guilty, and given a year in Southport. The DOC would not consider that Michael's medications caused a false/positive on the test. The DOC feels that the test is calibrated well enough for a prison, even though it may not be 100% accurate. I tend to think that if this happened to anyone reading this on their job, and they lost their job because of it, they'd be fuming, and looking for a Lawyer! Well, that's what Michael's close friends and family have done.

We know it's not a sure thing that we'll be successful, but Michael didn't use drugs (of course some of you never believe that) so we have to help him fight! He didn't deserve to be at Southport either, as that was from being set up (at Franklin) because he refused to be extorted.

Although I only raised $1200.00 out here, his family came through, and we found a reasonable Lawyer. We are still almost $1000.00 short, but the Lawyer will let us pay that over the next few months, We feel that Michael should at least try to fight this, as after 18 months in Southport, I don't know how to keep him motivated for another 12. We still hope that he'll be able to do this time in another facility, where he won't be so isolated, so hopefully the Lawyer can help with this as well.

Michael was not happy that I was collecting money for a Lawyer. I did mention when I made this request that Michael doesn't approve of asking for money, and I made the decision on my own. At least by doing so, I got a great new supporter who has been helping so much with research! I do hope to be able to raise the rest of the money asap, as only about 8 people actually gave money. I thought if all of the blog readers gave a small amount, like $10.00, it wouldn't be a burden to most. I do understand that some people can't even send that, and I don't want those people to send money at all.

New news, Michael Alig to be transferd

Good and bad news about Michael, as he had a visitor on Saturday. The Hearing is finished, and he was found guilty (of course) and given 1 year in the SHU. He just recently finished 18 months of that, so they expect him to be in isolation for 2 1/2 years total! The past 18 months have taken a toll on him, and now he's facing more time!

Michael has not been doing well because of this and has been transferred back and forth 5 times in the past month to different prisons where he could be watched. This has now resulted in a big change in his mental state, as he just doesn't know how he can be isolated for another year! He has been listening to his family & friends all this time trying to motivate him to make it, and he did, we all thought.

Because of this change in Michael's mental state, he will now (because of a new NY Law) no longer be allowed to do any SHU time in Southport. He will be transferred to Marcy within a week or 2. This is while he completes his 1 yr. SHU time, and, he'll be eligible to receive a time cut of 6 months. So, he MAY only be there for 6 months, then MAY be transferred to a regular prison to do that 6 month drug program as required. If at that time he gets enough "Good Time" back to be released, then he could be released from prison. .

This MAY only change when we expected him to be released by 6 months. None of this is in stone of course! Just with Michael being in a prison where he can call family and friends, and to be able to paint again will lift his spirits and give him hope!

Michael is interested in hiring a Lawyer, but only if it will result in a hair follicle test to prove his innocence. We will need to raise $8000.00 to $10,000.00 for this, and considering I only have $1200.00 (should be $1600.00 soon) so far, I don't know if this will happen, but I'll try.

I know everyone is waiting for an address, but you might as well send to Southport. His Hearing today was not completed, so he'll probably be there until it is.

Where is Michael Alig?

Good question! Can I answer it? Some days yes, some days no, some days maybe! I thought when he was leaving Southport this week for good, well he said he was! Now we learn he was at 5-Points, but going back to Southport!

Since I really don't know all the facts (only some), I will give a guess. I think he's going back to Southport for the Hearing, which is on Monday. Then hopefully he'll go back to 5-Points, if that is his final destination!

I'm also sitting here with letters to send, and hopefully on Tues I'll know where to send them!

Michael Alig ready to be transferred!

Michael may be transferred as early as today! He told his visitor this yesterday, and I received a letter today stating that he finally met with a Psychiatrist that seemed to care, and he'll be taken out of Southport asap! I believe this may be from his "team" writing and calling the prison, along with a Lawyer from PLS starting to contact Michael.

He's so happy to get out of there, but he's concerned about that ticket he got. He was told that when you leave Southport going to another prison, the ticket "is squashed." Michael is not so hopeful, but we'll all help him fight it, right? We need to stand together for him, as it worked this time.

I have to thank his mom, and the rest of "The Team" for helping, but it's not over! As soon as I know which Prison and address, I'll post it here.

Michael back at Southport

Michael is at Southport, and he's still unsure of his future. There are 5 of us that are working to help Michael fight this, which includes getting a professional. I'm sorry to say only 4 people decided to donate to Michael's Lawyer fund, which means I have $640.00. There seemed to be so many concerned people, and if they only gave a little each, it would add up, well, I was hoping for that! Maybe there's hope?

Michael states that there's no way he'll win accusing a staff of tampering with the test, and that he could get even more time! He was on a medication, and he had me look it up, and it does cause a false-positive for THC on a drug test! I have sent him this info, and hopefully the prison will allow this info in.

Michael is in real need of visits and letters! He needs his friends! All we can do now is try to keep him positive, and that won't be easy.

Michael is back to Southport?

Michael's mom reports this morning that Michael is back at Southport, so I guess we'll have to do a mad rush and send his Birthday cards there. With how things change lately, I don't know how long he'll be there, but I will assume he's there for now and send mail there.

I am hoping he'll be able to borrow stamps and write to me, as I really need to hear directly from him. His mom and some of his friends have been working hard to put pressure on the prison to get the truth, which we still believe that his urine test was switched or tainted. I'll feel better reporting on here when I hear from Michael directly.

I will keep updating as I get new information.

Getting a Lawyer

Message from Michael's mom

Hi, this is mom Alig. Earlier today I called five points corr. fac. with Michael's brother. we spoke to the counselor that had been interviewing him over the weekend. Michael told the whole story about what had happened to him and the harassment he has had to endure by a certain guard. Everything has been documented. Yes, Michaels going back to Southport but the Superintendent there has also been informed by me and Michael's brother of the situation. I also wrote a very long informative letter to the super at s.p. which he had in his possession as we spoke to him. The guard in question is now under investigation as we have made a formal complaint against him. Knowing the circumstances under which Michael's urine test was taken, we hope the ticket he got will be tossed out. If not, we need to get a lawyer and fight this tooth and nails. I have also turned this complaint into the Gay and Lesbian association in n.y. state and they will get this into the right hands. When I spoke to five points corr. fac. I asked them to give Michael a message letting him know that we are fighting for him on the outside and that he is not alone. Michael fears his friends will leave him. Listen to me, if you are really a friend of my sons then let him know you believe in him. We all know how homophobia can destroy a persons life. This is when my son needs his friends the most.

Michael needs our help!

I'm sorry to say that Michael has been singled out again by a CO (Correctional Officer) who has had it out for him because of another incident that happened in 2009. In 2009, Michael went for a usual random drug test. They have 3 hrs to give a sample, as when you have someone watching you it's harder to go. Well, this CO verbally sexually harassed Michael for the entire 3 hrs, with all kinds of Gay slander. Michael in the past would just ignore it, and he was trying to do that, but also had to give a sample.

Michael was not able to give a sample within the 3 hrs, and was given a ticket. Michael actually won at the hearing, as they believed he told the truth about being harassed! Michael said that almost never happens!

Well, now in 2012 at Southport, a few days before Michael is to leave, another urine test, as they are given often there. While in the holding pen with Michael, 2 other inmates admitted that they were in trouble, as they had been smoking pot. Michael was not worried at all about this test since he's been sober for 3 years now. He did the test, and was very surprised to be awakened the next morning with a ticket, for a dirty urine! Michael then saw that the same CO from 2009 was the one who tested the urine, and he knew he'd been set up.

This threw Michael in a big state of anxiety, with all kinds of feelings, mostly he was hopeless, as all he had worked for was now thrown away. He just did 18 months in that Hell Hole, and now he faced another year! Michael became despondent and was sent to another prison to be kept safe.

Even with Michael's mom trying to help, and she was assured Michael would be treated fairly, but he was not. To get Michael back to Southport, the Mental Health staff at Wende lied to Michael and told him that his Hearing would be done by a certain Officer that was very nice, and Michael would be allowed to tell what happened. Well, they lied to get Michael out of there, so they didn't have to deal with him, exactly what their job is!

Well, Michael went back to Southport, was told by Mental Health that no such arrangement was made, and he had his Hearing, and lost! Michael was devastated, as he has never used Pot in prison, probably not used it in 20 years! Why would he now?

Michael once again was very despondent, as he wrote me his letter while he was doing something that had him sent to his new home, Five Points. This prison has special Mental Health Housing for inmates in the SHU.

So, I hope Michael is still alive, but there's a good chance that he may not survive this. Just reading his letter, the pain he's in. He has tried so hard, been clean 3 years, which is not easy in prison as the tempt you all the time, as the other inmates want to make money! I fear for his life, and am talking to an old friend, his mom, and other close friends to figure out how to help him. The only thing that will help, is to get the Ticket thrown out!

This CO switched urine, or poured some of the other inmate's dirty urine into Michaels. He committed a crime! I would think that the prison should set a good example for their inmates, not expose them to more crime.

I am now collecting money for a Lawyer, and also Lab tests so we can prove that Michael has not smoked pot! A hair test goes back quite a ways! Since we don't have a Lawyer name yet, money sent if not sent without a name on it, then it will have to be mine. Either way, writing in the memo section that it's for Michael Alig's Lawyer should make people feel secure about donating now, as we must raise a $5,000.00 retainer. Michael doesn't know I'm asking as he never wants me to ask, but I am. His life is at stake, and he's worth saving! I hope you can help!

I know everyone is anxious, but things are not going well for Michael. I will write about it soon, but for now, here's where he is, and he certainly can use letters! I hope if we ask for support from all of you I'll get a good response, but first I need to get more advice. He was out of stamps, so it will take him time to respond depending on when he goes to commissary, and when his money is transferred there. Sometimes it takes 4 weeks for his money account to reach him.

I have not heard directly from him from this prison yet, so I don't know if he's there for good, but he might be. He needs your encouragement, and I'm sorry I can't say more, I just want to get him help first if possible.

Finally some good news for Michael Alig!

Michael has been waiting to hear about his last time cut, which those of you that keep in contact with him know he's been anxious to hear! He finally got word that he received a 32 day time cut, so his last day at Southport will be April 12th!

He won't know where he'll be sent, but in the past he's gone to Coxsackie, so it's a possibility. Just to get out of Southport, where humans are treated like animals will be a happy day! Plus, he'll be able to receive packages in time for his Birthday! It is very hard to buy him things, as the prison always comes out with new rules, but I will try to get him to let me know what he needs. When he went to Southport he had to send out 2 bags of property, as the new prison rules now limit how much they can have, so he may need to see what he has before he knows what he needs!

Depending on when he is able to start the 6 month drug class, we won't know till then when he'll be eligible to be released, as he must complete it first, even though he tested negative for drugs. I would think the end of October would be the earliest, but that may be wishful thinking. New York wants to waste tax payers money making him sit through a class he's been through before, and even helped teach last time! Hopefully he'll be out of prison by the end of this year!
